Starbucks Card Terms of Use

This Starbucks Card Agreement ("Agreement") is between you and Espresso Partners Limited trading as Starbucks New Zealand ("we" or "us") and describes the terms and conditions that apply to your Starbucks Card. By buying, loading, or using your Starbucks Card, you agree to these terms.

Our Privacy Policy is incorporated into these Terms of Use (in the then current form, from time to time) and also governs your participation in Starbucks Rewards and Starbucks Card. Please read the Privacy Policy carefully to understand how Starbucks collects, uses and stores information about customers, how to update or change your personal information, and how we communicate with you.

About Your Account

We issue the Starbucks Card to you. It allows you to load a dollar value onto your Starbucks Card for use at Starbucks stores in New Zealand. The dollar value that you load onto your Starbucks Card is a pre-payment for the goods and services of participating stores. We offer the Starbucks Card to make it easier for you to shop with us and to make your relationship with us more rewarding. The dollar value on your Starbucks Card is non-refundable and may not be redeemed for cash.

Starbucks Cards are not targeted towards, nor intended for use by, anyone under the age of 14. If you are between the ages of 14 and 17 (inclusive), you may only use Starbucks Cards under the supervision of a parent or legal guardian who agrees to be bound by this Agreement.

All dollar values are listed in New Zealand Dollars (NZD) unless otherwise stated.

When you register your Starbucks Cards with the Starbucks® Rewards program, the Starbucks® Rewards terms of use will also apply.

Loading Value on Your Card

You can load value on your Starbucks Card by visiting any Starbucks store in New Zealand, going online to member.starbucks.co.nz, or via the Starbucks New Zealand App. There may be a delay from the time you pay the amount to be loaded onto your Starbucks Card and those funds being available for use. Accepted payment methods include VISA, MasterCard and American Express Cards online and instore, with the addition of cash and debit cards instore.

You may not have more than $500 in value on any of your Starbucks Cards at any time. The minimum amount that you may load on any Starbucks Card at any given time, is $10.00. We may change any of these amounts at any time without notice to you.

You may reload either manually online when you choose or set up auto-reload when this feature is made available on member.starbucks.co.nz or by using the App.

With automatic reload, you simply set the balance at which you want to reload your Starbucks Card and provide us with payment information. We will send you an email confirming the automatic reload and bill your credit card or certain other electronic payment methods according to the schedule and amount you have selected. You can change your reload preferences at any time, but changes may take up to twenty-four (24) hours to go into effect.

To discontinue the automatic reload feature, you must log-in to your Starbucks account via member.starbucks.co.nzs or by using the App at least twenty-four (24) hours before the next scheduled reload. Once the dollar value is loaded, the transaction cannot be reversed.

Use of Starbucks Cards by Businesses

Starbucks Cards are intended to be purchased and utilised by consumers for personal use. If you would like to use Starbucks Cards for business purposes, please contact rewards@starbucks.co.nz. Additional requirements and restrictions may apply.

Starbucks Digital Gift Card

The Starbucks Digital Gift Card (also known as an "eGift") program allows you to purchase and send a virtual Starbucks Card via email to yourself or another recipient. You may choose the design and dollar value (within certain limits) and complete your purchase using a Visa, MasterCard or AMEX card, or certain other electronic payment methods. You must authorise us to charge your credit card, or other chosen electronic payment method at the time you purchase your eGift.

Gifting of e-Gift Cards

An email notification will be sent to the recipient of the eGift notifying that they have received an eGift from you. The recipient will have the option of adding the eGift to their Starbucks Account, transferring the balance onto an existing Starbucks Card or printing out the eGift and bringing it into a Starbucks store to make a purchase.

Each eGift has a unique Starbucks Card number associated with it no matter how many times the email is printed out.

The recipient will also have the option to register the eGift for use with Starbucks mobile applications if the recipient is a member of the Starbucks Rewards Programme.

We will also send you an email confirming that your eGift has been sent to the recipient.

An eGift is like any other Starbucks Card and should be treated like cash by the recipient. eGifts are not redeemable for cash.

If an eGift has not been redeemed within 30 days from date of issue, the sender will receive an email with a new verification link so that they can redeem the gift card themselves. The sender will then have another 30 days to redeem the gift card. If the sender redeems the eGift after 30 days, the sender will be asked to contact rewards@starbucks.co.nz in order to re-active the link to use the eGift.

Promotional Programs

From time to time, we may in our sole discretion, run promotional programs associated with the Starbucks Card program ("Promotions"). Such Promotions are subject to these terms, as well as additional terms as indicated in connection with the Promotions. We reserve the right to modify the terms and conditions of any Promotion at any time, including and up to terminating the Promotion.

Fees and Expiration of Card Balances

Without notice to you, Starbucks also reserves the right to "unregister" and make ineligible for Starbucks Rewards any Starbucks Card or account that has been inactive for two (2) consecutive years after the last financial transaction. The term “financial transaction” shall mean one of the following actions:

·Activation

·Reload

·Redemption of rewards for a registered Starbucks Card

·Purchasing Transaction

·Fund Transfer (as defined herein below) between the registered Starbucks Cards.

In the event that your Starbucks Card or account is unregistered or rendered inactive, all accrued Stars in your account are void.

Starbucks reserves the right to impose limits on card balances and/or expiry dates.

Receipts and Transaction History

You can check your transaction history, card balance, top up and de-register your Starbucks Card at member.starbucks.co.nz or by using the Starbucks New Zealand App.

You can check the balance and top up your Starbucks Card in any Starbucks stores in New Zealand.

The account balance for a Starbucks Card also will appear on your receipt from a point-of-sale register. We will not send you statements of activity on your Starbucks Card.

Billing Errors and Corrections

We will correct the balance of your Starbucks Card if we believe that a clerical, billing, or accounting error occurred. If you have questions regarding your transaction history or any correction, or if you wish to dispute any transaction or correction that has been applied to your Starbucks Card, please mail rewards@starbucks.co.nz or complete the feedback form on member.starbucks.co.nz or by using the App.

Fraud Associated with Your Starbucks Card or Card Balance

We will not accept any Starbucks Card, or will limit use of any Starbucks Card or Starbucks Card balance, if we reasonably believe that the use is unauthorised, fraudulent or otherwise unlawful, and we consider such action appropriate to limit our risk. Starbucks has no liability to you for any third-party fraud or unlawful activity associated with any Starbucks Card balance. we may in our sole discretion, cancel all impacted Starbucks Cards and retain all related Starbucks Card balances without notice to you. We may use retained Starbucks Card balances to help offset our liability to card companies, networks and issuers of lost or stolen credit and debit cards used to purchase or load Starbucks Cards.

Registration, Liability for Unauthorised Transactions

To register your Starbucks Card, visit member.starbucks.co.nz or by using the App. Click "Add a card" and complete the steps. When registering or purchasing a Starbucks Card, you agree that you will: (i) provide complete and accurate information about yourself; and (ii) update such information if it changes. If you do not provide or update such information, or if we have reasonable grounds to suspect that you have not provided or updated such information, we shall have the right, in our sole and absolute discretion, to disable your Starbucks Card.

You are responsible for: (a) the accuracy of all information that you provide to us; and (b) maintaining the confidentiality and security of your Starbucks Card information. All of your Starbucks Cards can be activated and registered for use in your Starbucks® Rewards account, but you may only maintain one (1) such account at any time.

You should treat your Starbucks Card like cash and not disclose your Starbucks Card information to anyone. Starbucks are not liable for any lost, stolen, damaged or destroyed Starbucks Cards. If your Starbucks Card or Starbucks Card information is lost or stolen, anyone who obtains possession of either may use your Card. You are responsible for all transactions on your Starbucks Card, including unauthorised transactions. However, if your Starbucks Card is lost, stolen or destroyed, your Starbucks Card can be replaced with the balance remaining on it at the time you contact us, but only if you have previously registered it with us. Fees for a replacement card may apply.

If your registered Starbucks Card becomes lost, stolen, or damaged, report it as soon as possible by completing the feedback form on member.starbucks.co.nz or by using the App.

Unless otherwise noted, all materials on our Website, App and Starbucks Card are protected as the copyrights, trade dress, trademarks and/or other intellectual properties owned by Starbucks and/or its subsidiaries and affiliates or by other parties that have licensed their material to Starbucks. All rights not expressly granted are reserved.

Your use of the materials included on our Website, App and Starbucks Card is for informational purposes only. You agree you will not distribute, publish, transmit, modify, display or create derivative works from or exploit the contents of this site in any way. You agree to indemnify, defend and hold harmless Starbucks for any and all unauthorized uses you may make of any material on our Website, App and Starbucks Card. You acknowledge the unauthorized use of the contents could cause irreparable harm to Starbucks and that in the event of an unauthorized use, we shall be entitled to an injunction in addition to any other remedies available at law or in equity.

Some links on our Website and App will allow you to connect with sites that are not under our control. We are providing these links only as a convenience. The appearance of a link does not imply Starbucks endorsement, nor is Starbucks responsible for the contents of any linked site. You access them at your own risk.

Amendments to these Terms of Use

Starbucks encourages you to regularly check these Terms of Use, learn about the latest version, and consider whether or not to continue to use the Website, App or Starbucks Card.

Starbucks has the right to revise these Terms of Use from time to time. In such case, Starbucks will publish the amended Terms of Use on its Website. If you continue to use the Website, App or Starbucks Card on or after the effective date of any such amendment, it will be deemed that you accept these Terms of Use as amended.

These terms are governed by the laws of New Zealand.
