In-Store Wi-Fi Terms of Use

Tahua Capital Ltd trading as Starbucks New Zealand (Starbucks NZ) allow customers to access our Wi-Fi services in-store. The use of Wi-Fi is subject to the following Terms of Use. These terms may be revised from time to time. If you do not agree to comply with these Terms of Use, you must not access or use this service.Our Privacy Policy is incorporated into these Terms of Use (in the then current form, from time to time) and also governs your use of Starbucks Wi-Fi. Please read the Privacy Policy carefully to understand how Starbucks collects, uses and stores information about customers, how to update or change your personal information, and how we communicate with you.

General

By using or accessing our Wi-Fi services, you acknowledge that you understand and agree to these Terms of Use. 

Starbucks NZ does not guarantee the availability, quality or performance of its Wi-Fi services, and it does not provide any warranties or guarantees of any kind (express or implied) with respect to this service. This is a complimentary service. Starbucks NZ reserves the right to restrict or suspend its Wi-Fi services at any time and at its discretion. 


Starbucks NZ has no control over the information on the internet. It is your responsibility as a user of the service, to determine the validity, quality and relevance of the information obtained through our Wi-Fi services.


Starbucks NZ reserves the right, at our discretion, to update or amend these Terms of Use from time to time without notice. We suggest that you check our website regularly for any changes to these Terms of Use

Inappropriate behaviour

Starbucks NZ intends for the Wi-Fi service to be used in a manner that does not offend the standards of the general community and may in its absolute and sole discretion, limit or block websites that do not meet those standards. 


Without limiting the foregoing, our Wi-Fi services are not to be used to access unlawful websites or to promote or carry out any unlawful activity, or to access any websites and/or content that:

i) Could cause Starbucks NZ to breach any law governing its conduct or to incur a liability to any third party;

ii) Could interfere with the integrity and/or performance of the hotspot, Starbucks network or equipment;

iii) Depicts, alludes to, or promotes offensive or illegal behaviour;

iv) Promotes racism, bigotry, hatred or physical harm to any group or individual;

v) Harasses or promotes harassment of another person;

vi) Exploits people in a sexual or violent manner;

vii) Contains nudity, violence or offensive subject matter or which may connect to adult websites;

viii) Promotes conduct that is abusive, threatening, obscene or defamatory;

ix) Intentionally infringes copyright;

x) Involves the transmission of junk mail, chain letters or unsolicited mailing, instant messaging or spamming;

xi) Promotes criminal activity;

xii) Contains or could introduce viruses, Trojan horses, worms, time bombs, cancelbots, or other computer programming routines that may damage, interfere or intercept access; or

xiii) Could reflect poorly on the reputation of Starbucks NZ.

If Starbucks NZ becomes aware that websites are accessed in contravention of these Terms of Use, it reserves the right to immediately terminate and block the access without prior notice. Starbucks NZ also reserves the right to refuse access to its Wi-Fi services to anyone whom it reasonably believes has or may breach these Terms of Use. 

Users should be aware that the browsing or downloading of illegal information from the internet could lead to prosecution.

Security

Starbucks NZ cannot guarantee the security of the Wi-Fi at all times. It is or may be a public network, and your access and use of the Wi-Fi is at your own risk. The onus is on you as the user, to ensure that usernames, passwords and security-based information are kept private and that internet security and firewalls are installed on your device to prevent unauthorised access.

Starbucks NZ is not liable for any kind of loss or damage you may sustain as a result of your use of its Wi-Fi services.

Privacy

Starbucks NZ respects your right to privacy and, except as set out in our Privacy Policy or in these Terms of Use, will not collect any of your personal information through your use of our Wi-Fi services.

By using or accessing our Wi-Fi services, you acknowledge and agree that: 

    Starbucks NZ may collect and process your personal information or web browsing activity to ensure that your use of its Wi-Fi service is not in breach of these Terms of Use

    For compliance and contact purposes, Starbucks NZ may require some of your personal information as a pre-requisite to granting access to our Wi-Fi service 

    Starbucks NZ may collect and process information about your web browser type and/or operating system to better optimise the services provided, such as determining the most effective and/or customised means of displaying the relevant website on your device 

    Starbucks NZ may disclose your personal information to co-operate with legal authorities in the investigation of any suspected or alleged crime or criminal wrong involving our Wi-Fi services 

Starbucks NZ is not responsible for any third party collection or use of your personal information obtained through your use of our Wi-Fi services, and you should make your own enquiries to satisfy yourself of the security of your web browsing and applicable policies for use of personal information by the websites accessed by you.

Release and indemnity

By using Starbucks NZ’s Wi-Fi services, you release and discharge Starbucks NZ from any liability which might arise from the use of our Wi-Fi services, including liability in relation to defamatory or offensive material or any breach of copyright which may occur as a result of use.

To the fullest extent permitted by law, you agree to indemnify and must defend and hold harmless Starbucks NZ, its employees and agents, from and against all loss, damage, liability, charge, expense (including all reasonable legal and other professional costs on a full indemnity basis) of any nature or kind arising from your use of our Wi-Fi services and/or any breach of these Terms of Use.These Terms of Use are governed by New Zealand law.
